
Our Terms & Conditions
These Terms and Conditions apply to all employment placement business undertaken with Chamber Recruitment Services (CRS) or its agents and/or sub-contractors with any other party (hereinafter referred to as the 'Client'). In the event of conflict with any other terms and conditions, these Terms and Conditions shall prevail and any change or variation will be valid only if confirmed in writing by CRS. In accordance with The Conduct of Employment Agencies and Employment Businesses Regulations 2003, CRS acts in the capacity of an Employment Agency in the provision of permanent staff.
1. Appointment Fee
An appointment fee is payable to Sheffield Commerce Recruitment Service (CRS) as soon as the candidate commences an engagement (not necessarily the positions notified) within the Client's company or group. When an employee is recruited through CRS for a position within the Client's company or group, a fee shall be charged based on the gross salary which the candidate is entitled to earn during the first 12 months of engagement by the Client (subject to a minimum charge of £500). Introductions are confidential. If a candidate introduced by CRS to the Client shall with 6 calendar months of such an introduction be employed and/or engaged (for example as a freelance worker or for a temporary contract) by the Client or by a third party as a result of an introduction effected by the Client, the Client shall pay the Company an Appointment Fee in accordance with the terms shown above.
An introduction fee calculated as above will be charged in relation to any Applicant engaged (whether on a temporary, permanent or self employed basis) as a consequence of or resulting from an introduction by or through CRS.
The assignment is accepted on a contingency basis by SCCI. Any and all advertising is conducted at the professional discretion of SCCI. There is no exclusivity offered or implied. A fee will only become payable on the successful starting of a candidate.
2. Responsibility for Selection
CRS shall provide a shortlist of candidates for the Client, conducting initial screening and selection as necessary. It is the Client's responsibility to make the final selection and appointment of a candidate.
To assist CRS in finding and providing a suitable candidate, the Client shall give all relevant information about the position and its requirements for a suitable candidate prior to an introduction being made. CRS shall use its best endeavours to select candidates in accordance with instructions given by the Client, but no guarantee can be given as to a candidate's suitability for the appointment.
The Client must verify at the time of engagement that the applicant is capable of carrying out the duties required and must ensure that any requirement or qualifications required by law for the particular placement are satisfied. Prior to the placement of any candidate, CRS will be responsible for the verification of any references provided by the candidate. The Client will be responsible for obtaining work permits or any other applicable permits or checks and arranging medical examinations where appropriate.
No liability will be accepted by CRS for any loss, damage, expense or delay arising directly or indirectly from the supply to the Client of any candidate for a period of engagement or from the failure to supply any candidate, or from the negligence, dishonesty, misconduct or lack of skill of the candidate provided.
3. Employment Offers
Clients are required to send CRS copies of all offers of employment with candidates and, in addition, to advise CRS in writing of the acceptance or rejection by a candidate of an offer of employment.
As soon as the candidate is appointed, it is the Client's obligation to provide CRS with the date upon which the candidate is to commence work and full particulars of the candidate's basic salary.
4. Satisfaction Guarantee
Termination of a candidates placement either by the Candidate and/or the Client before the expiry of eight weeks for any lawful reason except redundancy, shall entitle the Client to a rebate in accordance with the Satisfaction Guarantee Scale of Refund shown hereunder provided that CRS has received payment of the relevant invoice as detailed under 'Appointment Fee' and that the Client notifies CRS in writing within seven days of the date of the invoice, or the date of termination, whichever is later.
If, after the offer of engagement has been accepted by the Applicant, the Client decides for any reason not to proceed with the appointment, the Client shall be liable to pay CRS the minimum administration fee as indicated on the Scale of Refund and any additional cost involved.
Should the Client or any subsidiary or associated company of the Client subsequently re-engage the applicant within a period of six calendar months from the date of termination of a placement, a full Appointment Fee in accordance with (1) above, becomes payable with no entitlement to a refund.
Should the applicant decide for any reason not to take up employment and then at a later date take employment, a full Appointment Fee will be charged to the client, payable within 30 days. Should a flat fee be arranged, no credit/refund will apply.

5. Advertising
CRS will advertise the position locally if necessary. Should the Client wish the position to be advertised on a regional, national or international basis CRS will be pleased to offer advice and costings as required. CRS retain copyright on all advertising and other written pictorial material produced by them, and such material may not be reproduced, all or in part, without their written permission.
6. Payment Terms
The Client shall be liable to pay the 'Appointment Fee' on the first day that the Candidate commences the engagement with the Client or any of its subsidiary companies whether on a temporary, permanent or self-employed basis and whether or not the position is the same as that for which the introduction was made. All Fees are expressed in pounds sterling and are exclusive of VAT. Where appropriate, VAT (at the rate current on invoice date) will be added.
All Fees are payable within 30 days from the date of invoice. In the event of late payment by the Client of any valid invoice, or any valid part of any invoice otherwise in dispute, CRS shall be entitled to charge interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 on a daily basis at an amount equal to the prevailing statutory interest and base lending rates to any amounts outstanding from 30 days following the date of invoice.
7. Acceptance of Terms
CRS Terms & Conditions are deemed to be accepted upon receipt by CRS of a signed copy of these Terms & Conditions or by receipt of instructions from the Client, whether written or verbal, to identify candidates for engagement.
